Prominent actor and comedian Marlon Wayans stands accused of a disruption of peace, an allegation he contends to be unjust, stemming from an altercation with an airline employee. Wayans believes the conflict, which originated from a luggage dispute at Denver’s airport, is racially motivated.

The attorneys representing Wayans, a Black man, submitted a request for the dismissal of the case in a court proceeding on Thursday. Wayans was issued a citation for disturbing the peace, a municipal offense, in June. As per the court documents, a United Airlines representative denied Wayans the right to board a flight to Kansas City with three pieces of luggage.

In a surprising turn, after complying with airline regulations by reducing his luggage to two bags, Wayans was physically obstructed by the gate agent from boarding the flight. Wayans, however, managed to board the plane, only to be later asked to disembark before the flight took off.

While Wayans was occupied with adjusting his luggage, the same gate agent permitted white passengers carrying three bags each to board the plane. The court documents mentioned this evidence and comprised of still images captured from a surveillance video identifying white passengers with multiple bags lading the flight. The flight had approximately 140 occupants, many carrying three or oversized bags, a clear infringement of the airline’s policy.

The defense for Wayans charges the gate agent with racial discrimination. They assert that the continuity of charges by Denver’s prosecutors perpetuates this discrimination and infringes on Wayans’ right to equal protection under the law. “The stance held by the City of Denver represents an insult to constitutional and social equity principles,” stated the defense on behalf of Wayans.

Official comments from the city attorney’s office or United Airlines were not available at the time. In the previous instances, however, United Airlines asserted that an “unnamed customer” had “pushed past” a staff member while trying to board the plane.

As referenced by police body camera extracts contained in the document, the gate agent alleged Wayans of using physical force while boarding the plane. Wayans’ legal team refutes these claims, suggesting the contact might have been only a brush of the shoulders with the agent.

According to the court filing, the police officers who followed up on the incident expressed doubts over the occurrence of any crime. Despite this, the gate agent insisted on pressing charges.
